NOTICE OF SALE
Default has been made in the condition of a certain mortgage made the 5th day of January, 2006, by Caiden J. Withey and Sarah E. Withey to Northwestern Mortgage Company, and recorded on January 13, 2006, in the office of the Register of Deeds for Emmet County, Michigan, in Liber 1074, Page 486, which was assigned to Northwestern Bank by Assignment of Mortgage recorded at Liber 1140, Page 965,and on which mortgage there is claimed to be due and unpaid at the date of this Notice ONE HUNDRED FORTY-SEVEN THOUSAND FIVE HUNDRED NINETY-SEVEN AND 37/100 DOLLARS ($147,597.37) and no suit or proceeding at law or in equity has been instituted to recover the debt, or any part of the debt, secured by said mortgage, and the power of sale contained in said mortgage has become operative by reason of such default.NOTICE IS HEREBY GIVEN that on June 14, 2012, at 11:00 oclock in the forenoon in the main lobby of the Emmet County Courthouse, 200 Division, Petoskey, MI 49770, there will be offered for sale and sold to the highest bidder, at public sale, for the purpose of satisfying the amounts due and unpaid upon said mortgage, together with legal costs and charges of sale, including an attorney fee of Seventy-Five ($75.00) Dollars provided by law and in said mortgage, the lands and premises in said mortgage mentioned and described as follows, to wit:
Township of Springvale, County of Emmet, State of Michigan
Commencing at the Northwest corner of the South 1/2 of the Northwest 1/4 of Section 2, Township 34 North, Range 4 West; thence South 870 feet to the Point of Beginning; thence East 1320 feet; thence South 258.5 feet; thence West 1320 feet; thence North 258.5 feet to the Point of Beginning, being a part of the South 1/2 of the Northwest 1/4 of said Section 2.
The redemption period shall be six (6) months from date of sale; provided, however, that if the subject premises are heretofore or hereafter conclusively presumed to have been abandoned pursuant to MCL 600.3241a, the applicable period for redemption shall be thirty (30) days from said date, or otherwise shortened, in accordance with that statute.
